TERMS OF SERVICE

These Terms of Service (“Agreement”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Still Dreaming, LLC, a California limited liability company (“Company,” “we,” “us,” or “our”). This Agreement governs your access to and use of the GoDu mobile application (formerly known as Buckit), the website located at trygodu.com, the GoDu Business Portal, and all associated services (collectively, the “Service”).

1. ACCEPTANCE OF TERMS

By accessing or using the Service, you agree to be bound by this Agreement. If you do not agree, you must not use the Service. If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these terms.

2. ELIGIBILITY AND CALIFORNIA WAIVER

Age Requirements: You must be at least 17 years of age to use the Service. By using GoDu, you represent and warrant that you meet this age requirement.
California Civil Code Section 1542 Waiver: Still Dreaming, LLC is a California entity. If you are a California resident, you hereby waive any rights you may have under California Civil Code Section 1542, which states: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”

3. DESCRIPTION OF SERVICE

GoDu, owned and operated by Still Dreaming, LLC, is a discovery and gamification ecosystem:

Consumer App: A mobile application allowing users to discover "Quests" via a swipe interface, view experiences on a map, and verify completion through photo/video uploads.
Business Portal: A web-based platform hosted at trygodu.com for experience-makers to list, manage, and track the performance of their offerings.
Platform Nature: The Service is built on the Bubble.io platform. Service availability is subject to the uptime and performance of Bubble.io and its third-party hosting providers.

4. USER ACCOUNTS AND CONDUCT

Account Security: You are responsible for maintaining the confidentiality of your login credentials.
Prohibited Conduct: You agree not to trespass, violate any laws, or endanger yourself or others while attempting "Quests." You may not submit fraudulent "Verification Selfies" or attempt to "game" the XP/currency system.

5. USER-GENERATED CONTENT (EULA)

GoDu allows users to upload photos and videos ("User Content").

Moderation: We employ a "Human-in-the-Loop" moderation system. Content flagged as "objectionable" will be reviewed and may be removed globally within 24 hours.
Safety Tools: Users have access to "Flag" and "Block" features. Still Dreaming, LLC reserves the right to terminate any account found to be repeatedly violating safety standards.
License Grant: You retain ownership of your User Content. However, you grant Still Dreaming, LLC a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, and display such content for the purposes of operating the Service.

6. ASSUMPTION OF RISK AND RELEASE OF LIABILITY

REAL-WORLD ADVENTURE INVOLVES RISK.

Assumption of Risk: You acknowledge that participating in Quests discovered through GoDu involves inherent risks, including physical injury, property damage, or death. You voluntarily assume all risks.
No Verification: Still Dreaming, LLC does not verify the safety, legality, or accessibility of any Quest location. You are solely responsible for exercising caution and obeying all local laws.
Release: You hereby release and hold harmless Still Dreaming, LLC and its officers, directors, and employees from any and all claims or causes of action arising out of or related to any injury or damage you may sustain while participating in a Quest.

7. GAMIFICATION AND VIRTUAL CURRENCY

XP and Bucks: GoDu utilizes Experience Points (XP) and "Bucks" (virtual currency). These are for entertainment purposes only, have no monetary value, and cannot be redeemed for real-world currency.

8. INTELLECTUAL PROPERTY

All rights, title, and interest in and to the Service, the GoDu name, the trygodu.com domain, and associated branding are the exclusive property of Still Dreaming, LLC.

9. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED ON AN “AS IS” BASIS. STILL DREAMING, LLC EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW, IN NO EVENT SHALL STILL DREAMING, LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00 USD).

11. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Still Dreaming, LLC from any claims, damages, or expenses (including attorney's fees) arising from your violation of these terms or your conduct during real-world Quests.

12. ACCOUNT DELETION

You may delete your account at any time via the in-app settings. Upon deletion, Still Dreaming, LLC will remove your user record and personal bucket list items from our active database in accordance with our Privacy Policy.

13. DISPUTE RESOLUTION (ARBITRATION & CLASS ACTION WAIVER)

Governing Law: This Agreement is governed by the laws of the State of California.
Mandatory Arbitration: Any dispute arising out of or relating to this Agreement shall be settled by binding arbitration in the State of California, in accordance with the rules of the American Arbitration Association.
Class Action Waiver: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS OR REPRESENTATIVE ACTION.
